These Terms of Service (“Terms”) govern your access to and use of the FindMyHELOC website and services (the “Services”). By using the Services, you agree to these Terms.
1. Nature of the Services
FindMyHELOC is a marketing and lead-generation service. We are not a lender, mortgage broker, depository institution, or financial advisor. We do not originate, fund, or service loans, and we do not make credit decisions. Loan products, rates, terms, and approval are provided solely by third-party lenders and brokers in our network.
2. Eligibility
You must be at least 18 years old, a U.S. resident, and the legal owner of the property you reference in any form submission. By submitting information, you represent that the information is true, accurate, and complete to the best of your knowledge.
3. Consent to Contact
By submitting your information, you expressly consent to be contacted by FindMyHELOC, its affiliates, marketing partners, and participating lenders by telephone (including auto-dialed and prerecorded calls), SMS/MMS, email, and live agents, even if your number is on a federal or state Do-Not-Call list. Consent is not a condition of any purchase. Reply STOP to unsubscribe from SMS; standard message and data rates may apply.
4. No Guarantee of Approval
Submitting a form does not constitute an application for credit or guarantee approval. All loan offers are subject to the lender’s underwriting criteria, including but not limited to credit history, income, debt-to-income ratio, property value, occupancy, lien position, and applicable law. Rates, fees, and funding timelines vary by lender.
5. Acceptable Use
You agree not to:
- Submit false, misleading, or another person’s information without authorization;
- Use the Services for unlawful purposes;
- Attempt to interfere with, scrape, or reverse-engineer the Services;
- Upload viruses, malware, or harmful code.
6. Intellectual Property
All content on the Services — including text, graphics, logos, and software — is owned by FindMyHELOC or its licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FINDMYHELOC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FINDMYHELOC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
9. Indemnification
You agree to indemnify and hold harmless FindMyHELOC and its affiliates from any claim, loss, liability, or expense arising out of your use of the Services or violation of these Terms.
10. Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in St. Lucie County, Florida, unless required otherwise by applicable consumer-protection law.
11. Changes
We may modify these Terms at any time by posting an updated version. Continued use of the Services after changes constitutes acceptance.
